Terms of Service

These Terms of Service ("Terms") govern your use of the Dos Amigos Golf mobile application (the "App") operated by GMG Solutions LLC (dba Dos Amigos Golf) ("we", "our", or "us"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account or using the App, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms. Your continued use of the App following any updates to these Terms constitutes acceptance of those changes.

2. Use of the App

You agree to use the App only for its intended purpose of tracking golf games, scores, and related activities. You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to the App, other user accounts, or our systems and networks.
• Interfere with or disrupt the App, servers, or networks connected to the App.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
• Transmit any viruses, malware, or other harmful code through the App.
• Use the App to harass, abuse, or harm other users.
• Create multiple accounts for deceptive or abusive purposes.
• Use automated means (bots, scrapers, etc.) to access or interact with the App without our written permission.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to keep your information up to date. You must notify us immediately if you become aware of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe have been compromised.

4. Golf Data & Scoring Disclaimer

The App provides tools for tracking golf scores, handicaps, and match results. You acknowledge and agree that:

• The App is intended for recreational and social golf tracking purposes only.
• Scores, handicaps, and statistics calculated by the App are unofficial and should not be relied upon for official tournament play or official handicap purposes unless separately verified.
• Handicap values are player-entered for gameplay only and are not official.
• We do not guarantee the accuracy of scoring calculations or handicap computations.
• You are solely responsible for verifying the accuracy of your scores and game results.
• The App does not facilitate real-world exchanges between players.

5. Intellectual Property

The App, including its design, features, content, graphics, logos, and underlying code, is owned by GMG Solutions LLC (dba Dos Amigos Golf) and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

6. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or engaged in conduct that is harmful to other users or our business. Upon termination, your right to use the App ceases immediately. You may also delete your account at any time through the Settings screen. Provisions of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property provisions, disclaimers, and limitations of liability.

7. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE APP IS AT YOUR SOLE RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GMG SOLUTIONS LLC (DBA DOS AMIGOS GOLF), ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE THEORY OF LIABILITY. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE MAXIMUM AMOUNT PERMITTED BY LAW.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in the State of Washington, and you consent to the personal jurisdiction of such courts.

10. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of these Terms and, where appropriate, provide notice through the App. Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App and delete your account.

Program name: Dos Amigos Golf SMS Alerts

Description: SMS is used to deliver login verification codes for your account.

Message frequency: One text per login attempt.

Message & data rates: Message and data rates may apply.

Opt-out: Text STOP to opt out. Text HELP for help.
